Pursuant with NCAA Division II Bylaw 13.1.1.2.1, if St. Mary’s University decides to deny a student-athlete’s request to permit any other institution to contact the student-athlete about transferring, the Athletics Director (or designee) shall inform the student-athlete in writing, within 14 consecutive calendar days from receipt of a student-athlete’s written request, that he or she, on request, shall be provided an appeal hearing conducted by a committee outside of the Athletics Department.

A student-athlete who wishes to appeal any decisions related to denial of permission to contact any other institution shall submit a written request that includes:

  • The student-athlete’s name, ID number, and sport
  • Name of the institution or institutions the student-athlete desires permission to contact
  • Reasons for believing that the decision was unfair, including names of University personnel (coaches, faculty, counselors, etc.) with whom the student-athlete has discussed the denial
  • Copies of any relevant documents.

The student-athlete should submit these materials to the Faculty Athletics Representative within 10 business days after the student-athlete has received notification from the Athletics Department that permission to contact has been denied. The student-athlete may request an in-person appeal hearing conducted by a committee outside of the Athletics Department. The appeal is reviewed by that committee, and its decision is final.

Committee

The committee will consist of two staff members from the Office of the Dean of Students, one staff member from the Office of Student Retention, one member of the faculty, and the Faculty Athletics Representative, who serves as chair of the committee. The Senior Compliance Administrator will be non-voting participant.

Procedures

The student-athlete submits a request to the Faculty Athletics Representative for an appeal hearing. A hearing is scheduled within 30 consecutive calendar days of receiving the student-athlete’s written request for the appeal hearing, and the student-athlete, coach, and Athletics Director are notified of the time and location.

The Faculty Athletics Representative and Senior Compliance Administrator will review the request and submit comments to all concerned parties. Each side presents its arguments to the committee. Within 10 business days, the committee reaches a decision and the Faculty Athletics Representative will send the decision in writing to each party. The committee’s decision is final.
